Terms of Use

1. Introduction
These Terms of Use ("Terms") govern your access to and use of Moonomat (the "Service"), available as a web application, Android application, and Meta Quest application, operated by Moonomat, Switzerland ("we", "us", "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Service Description
The Service is available in the following modes:
- Free, without an account — the core design tools (editor, Moon runtime, viewer, local bundles, local sharing) are accessible without registration or login.
- Free account — signing in with a Google account additionally enables, at no charge, the Design agent (subject to a limited request allowance stated in the Service) and third-party integrations such as GitHub.
- Paid Subscription ("Moonomat Full Moon") — removes the Design agent request allowance and enables additional integrations such as Google Drive sync. Requires account creation via Google OAuth and an active monthly or annual subscription processed through Stripe.
3. Accounts & Authentication
3.1. Certain features — including the Design agent, third-party integrations, and paid features — require signing in with a Google account via OAuth. You are responsible for maintaining the security of your account and any activity that occurs under it.
3.2. You must be at least 16 years of age to create an account.
3.3. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions & Payments
4.1. Paid subscriptions are billed on a monthly or annual basis through Stripe. By subscribing, you also agree to Stripe's Terms of Service.
4.2. Subscriptions renew automatically unless cancelled before the end of the current billing period.
4.3. Refunds are handled in accordance with applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
4.4. We reserve the right to change subscription pricing with at least 30 days' notice.
5. User Content, Data Storage & Third-Party Integrations
5.1. Local Data Storage
Your data and content are stored locally in your browser (e.g., IndexedDB, localStorage) or locally on your device. This means your data may be lost if you clear your browser data, switch browsers or devices, use private/incognito mode, or uninstall the application.
We do not store, host, or back up your content on our servers. You are solely responsible for your data and for maintaining independent backups.
5.2. Optional Sync with Third-Party Services
The Service allows you to optionally sync or store your content via third-party services, including:
- Google Drive — for cloud storage and sync of your content
- GitHub — for version-controlled storage of your content
These integrations are provided as a convenience and do not constitute a backup service operated by us. Sync failures, third-party outages, or API changes may result in data loss. We strongly recommend that you independently back up your data through your own means, separate from the Service.
5.3. AI Backend Integrations
The Design agent operates exclusively on AI capacity that you provide ("bring your own AI"): you connect the Service to an AI provider account of your choice or to a server you operate yourself. By connecting a backend, you authorize the Service to use the credentials you supply to make requests on your behalf, directly from your device. We do not resell AI capacity and do not mark up provider pricing.
You are responsible for any usage and costs incurred with backends you connect, and for complying with the respective provider's terms. The currently supported backends are described in the Service and its documentation.
Companion software. For some backends we offer optional open-source companion software that you download and run on your own computer — for example, the bridge application ("agent-cli-bridge") that connects the Design agent to your locally installed agent CLIs (Claude Code, Codex). Such software is licensed separately under its own open-source license (MIT), is provided "as is" without warranty of any kind, and runs entirely on your machine: we do not operate it, and your prompts, credentials, and access tokens never pass through our servers. You are responsible for operating it securely (including keeping its pairing token confidential) and for ensuring that your use of it complies with the respective AI provider's terms — for the Claude backend, your agreement with Anthropic; for the Codex backend, your agreement with OpenAI. AI providers may change their terms, pricing, or technical policies at any time; we do not warrant continued availability or compatibility of any backend.
5.4. Your Responsibilities
You are solely responsible for:
- All content you create, modify, or manage through the Service.
- Maintaining adequate, independent backups of your data.
- Ensuring your use of third-party services complies with their respective terms.
- Any consequences resulting from data loss, whether caused by browser storage clearing, device changes, sync failures, or any other reason.
5.5. No Liability for Data Loss
To the fullest extent permitted by law, we disclaim all liability for any loss, corruption, or unavailability of your content, regardless of cause. This includes but is not limited to data loss resulting from:
- Browser storage being cleared, corrupted, or becoming unavailable
- Uninstalling or updating the application
- Failures or interruptions in third-party sync services
- Device loss, damage, or migration
5.6. Third-Party Terms
Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.
5.7. Published & Shared Content
The Service lets you share and publish your content — for example as share links that encode your content in the URL, as bundles hosted in your own public GitHub repositories (served via public CDNs), or as embeds on third-party websites. Content you publish or share in these ways is publicly accessible to anyone with the link or with access to the hosting location. You are solely responsible for the content you publish and for removing it (e.g., from your GitHub repository) if you no longer wish it to be available.
5.8. Library Content
The Service provides libraries of example designs and assets that you may copy into your own bundles and use in your designs, including commercially, unless a different license is indicated alongside the specific content. Third-party assets that you import from other sources retain their own licenses.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Attempt to gain unauthorized access to the Service or its related systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse-engineer, decompile, or disassemble any part of the Service, except to the extent this restriction is prohibited by applicable law or by the open-source license of an included third-party component (see Open-Source Licenses).
- Resell, sublicense, or redistribute access to the Service without our written consent.
- Abuse the free tiers (for example, by creating multiple accounts) to circumvent subscription requirements or usage allowances.
7. Intellectual Property
7.1. The Service, its original content, features, and functionality are and remain the property of Moonomat and are protected by applicable intellectual property laws.
7.2. You retain all rights to any content you create, store, or manage through third-party services via the Service.
8. Right of Withdrawal (EU Consumers)
If you are a consumer in the European Union, you have the right to withdraw from your subscription within 14 days of purchase without giving a reason.
By subscribing and using the Service immediately, you expressly consent to the Service being provided before the withdrawal period expires. You acknowledge that you lose your right of withdrawal once the Service has been fully performed during the withdrawal period. If you withdraw before that, any refund may be reduced proportionally to reflect the service already provided.

9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. AI-generated outputs accessed through the Service (via the AI backends you connect) may be inaccurate and should not be relied upon without independent verification.
10. Limitation of Liability
To the maximum extent permitted by Swiss law, Moonomat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.
11. Changes to These Terms
We may update these Terms from time to time.
- Non-material changes (e.g., typo fixes, clarifications that do not alter your rights or obligations) take effect immediately upon posting.
- Material changes (e.g., changes to pricing, liability, or data handling) will be communicated with at least 14 days' notice through the Service before taking effect.
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and, if applicable, cancel your subscription.
12. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Switzerland. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
